These Terms of Service (“Terms”) govern your use of https://baliburnoutretreats.com and any quote, booking, or service supplied by Bali Burnout Retreats (operated by PT Juara Holding Group, “we”, “us”, “our”). By visiting this site, requesting a quote, or confirming a booking, you agree to these Terms.
1. Definitions
- “Booking” — a confirmed reservation evidenced by deposit payment and our written confirmation.
- “Client” — the natural or legal person entering into a Booking with us.
- “Supplier” — the third-party operator (vessel owner, hotel, dive operator, transport company) that performs the actual on-the-ground service.
- “Trip” — the curated travel programme described in your Booking confirmation.
2. Our role
Bali Burnout Retreats acts as an independent travel curator and booking agent. We negotiate, coordinate, and confirm services on your behalf with the Supplier. The contract for the actual physical service (vessel charter, hotel stay, dive package, transfer) exists between you and the Supplier, with us as the booking intermediary. Where we are the Supplier directly, this is stated explicitly in the Booking confirmation.
3. Quote & booking process
- Quotes are valid for 14 calendar days from issue unless stated otherwise.
- A Booking is confirmed when (a) we issue a written confirmation, (b) we receive the agreed deposit, and (c) the deposit clears.
- Standard deposit is 30% at confirmation, balance due 60 days before the start of the Trip. High-season or peak-date Bookings may require larger or earlier deposits as stated in your confirmation.
4. Payment
Payments are processed via Xendit, Midtrans, or international wire transfer. All amounts are in the currency stated on the invoice (default USD or IDR). The Client bears any sender bank fees, recipient bank fees that exceed our published charges, and currency conversion costs imposed by the Client’s bank or card issuer.
5. Cancellation by Client
- More than 60 days before Trip start: deposit refund minus a 10% administrative charge.
- 30–60 days before Trip start: 50% of total Trip price refundable.
- 15–29 days before Trip start: 25% of total Trip price refundable.
- Less than 15 days: no refund except where the Supplier voluntarily offers one.
- No-show: no refund.
These percentages may be modified — and stated explicitly — for high-season Bookings, special-charter Bookings, or Bookings of bespoke vessels and villas with stricter Supplier policies.
6. Cancellation or modification by us / by the Supplier
If we or the Supplier must cancel due to operational reasons (under-booking, vessel mechanical issue, hotel closure), we will offer (a) full refund, (b) re-booking on equivalent dates without penalty, or (c) substitution with a comparable alternative at no additional cost. We will not be liable for consequential losses (e.g. flight rebooking) beyond the direct refund obligation.
7. Force majeure
Neither party shall be liable for failure to perform due to force-majeure events: natural disasters (earthquake, tsunami, volcanic eruption — including activity at Mount Agung, Mount Rinjani, Mount Merapi, or any active Indonesian volcano), severe weather, public-health emergencies, civil unrest, war, terrorism, government action including travel restrictions, port closures, harbour-master advisories, mandatory evacuations, or strike action by carriers or port authorities. In a force-majeure cancellation we will refund Supplier-recoverable amounts and will use reasonable efforts to recover non-refundable amounts; non-recoverable Supplier costs (e.g. fuel pre-purchases, perishable provisioning) are non-refundable to the Client.
8. Insurance
Comprehensive travel insurance covering medical evacuation, trip cancellation, baggage, and liability is required for all marine and remote-area programmes. The Client is responsible for arranging adequate insurance and providing the insurance certificate before Trip start. We can recommend reputable providers but do not act as insurance broker.
9. Health, safety & passport
- It is the Client’s responsibility to hold a passport valid for at least 6 months beyond the Trip end date and any required visa for entry to Indonesia.
- The Client must inform us in writing of any medical condition, allergy, dietary restriction, or mobility limitation that may affect the Trip.
- For diving programmes the Client must hold a valid certification (PADI, SSI, or equivalent), provide a current dive medical clearance where required, and observe safe-diving protocols including conservative ascent profiles.
- Children under 12 may have additional restrictions on certain activities (e.g. open-water diving, high-current snorkelling sites). The Client warrants compliance with these.
10. Conduct on board / on site
The Client and accompanying party agree to follow the lawful instructions of the Captain, dive master, hotel staff, or driver. We and the Supplier reserve the right to terminate a Trip without refund where the Client’s conduct endangers safety, materially disrupts other guests, or violates Indonesian law. Indonesian law strictly prohibits the consumption, sale, or carriage of narcotic substances (Undang-Undang Narkotika No. 35/2009) — violations carry severe penalties under Indonesian criminal law.
11. Limitation of liability
To the maximum extent permitted by Indonesian law, our liability for any direct loss is limited to the total Booking value paid by the Client. We exclude liability for indirect, consequential, or special losses including but not limited to lost profits, lost holiday enjoyment, and consequential travel costs. Nothing in these Terms limits liability for death, personal injury caused by our gross negligence, or fraud.
12. Intellectual property
All content on https://baliburnoutretreats.com — text, images, logos, video, layout — is the property of PT Juara Holding Group or its licensors and is protected by Indonesia Hak Cipta law (UU No. 28/2014) and applicable international copyright treaties. You may not reproduce, distribute, or create derivative works without prior written consent.
13. Data protection
Our handling of your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
14. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Indonesia. Disputes shall be settled by good-faith negotiation; failing which, the Client and Bali Burnout Retreats agree to refer the dispute to the Badan Arbitrase Nasional Indonesia (BANI) for binding arbitration in Jakarta, conducted in English with one arbitrator, in accordance with BANI Rules. Either party may seek injunctive relief from the competent Indonesian courts where strictly necessary.
15. Severability & entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force. These Terms together with the Booking confirmation constitute the entire agreement between the parties and supersede all prior representations.
16. Changes
We may revise these Terms from time to time. The version in force at the date of your Booking confirmation governs that Booking. Material changes will be communicated by a banner on the home page or by email.
